Childish Gambino sued for allegedly stealing ‘This Is America’ from Kid Wes
Childish Gambino is being sued by Emelike Nwosuocha popularly known with the stage name Kid wes for allegedly plagiarizing his tune, stealing his musical idea to record his Grammy Award-winning song “This Is America.”
He claimed that Childish Gambino imitated the tune he created in 2016 for his track “Made in America” to record his 2018 hit song “This Is America.” The rapper says that Gambino’s song is nearly a blatant rip-off of his song “Made In America,” which was released two years prior.
According to Kidd Wes he created his track on SoundCloud in September 2016 and released it on YouTube few months later for free streaming. He claimed he also registered the song with the U.S Copyright Office in May 2017, and it was supposed to be the lead single on his upcoming album.
Kidd Wes says that the hook from “This Is America” is nearly the same as his chorus from “Made In America,” and it features similar lyrical themes and flows. In the legal documents, the rapper claimed that the track is “unmistakably substantially similar, if not practically identical” to his.
As it relates to the lawsuit, Dr. Brent Swanson wrote a report “There are distinct similarities in melodic contour, rhythmic triplet flow in each performance, and the lines ‘Made in America’ and ‘This is America’ line up nearly perfectly in time despite being different tempos. They also both use rhythmic utterances in their performances.”
New York federal court is handling the case.
